Cobb County Jury Says “No” to Felony Charges in Marietta DUI Car Accident Case

DUI_Law2

A December, 2024 DUI car accident case serves as an example of how a DUI car accident case in Cobb County may shake out in court, and that those charged with DUI offenses may be found guilty of lesser charges against them in cases where they have been charged with both felony and misdemeanor charges. According to local news reports, in December, 2024, a 68-year-old driver was found to have hit a 17-year-old pedestrian while she walked through a crosswalk along Ben King Road, in Marietta. In the criminal DUI case, the jury heard the story of the tragic accident, in which the 68-year-old man and his wife were returning home from a Christmas party, when their vehicle struck the teenage girl. The teenage girl was returning home from looking at Christmas lights in the neighborhood with friends.

The 68-year-old man was ultimately charged with a number of charges, including driving under the influence and first-degree vehicular homicide. However, after the jury heard “ail recordings between Cox and his wife about how much they drank that night, there was body and dash camera video, and requests from both sides for mistrials” they found the 68-year-old man only guilty of the lesser charges against him, including second-degree homicide by vehicle and failure to exercise care towards a pedestrian. In the end, the 68-year-old man was sentenced to the maximum sentence allowed under Georgia laws, which means that he spent a total of only one day in jail after the trial (he had already served out 364 days of his sentence while awaiting trial).
