MMS Data Privacy Policy (Zoom‑Powered Messaging)
Arca Law uses Zoom Phone’s SMS/MMS platform for client messaging. The following policy language is provided directly by Zoom and governs the handling, transmission, and limitations of multimedia messages (MMS) sent or received through our system.
1. Definition of Text Messaging
“‘Text Messaging’ means and includes both SMS (‘Short Message Service’) messages, MMS (‘Multimedia Message Service’) [and, in the future, may also include Rich Communication Services (‘RCS’) and/or over‑the‑top (OTT) messages] (all together, ‘Text Messages’).”
2. Service Basis / Delivery Disclaimer
“Text Messaging Service is provided ‘as is’ on a ‘best efforts’ basis. Zoom utilizes underlying messaging application service providers and carriers (whether fixed or wireless) to deliver Your Text Messages to intended recipients. … Zoom cannot and does not guarantee that Your text messages or alerts will be delivered or that delivery will meet any quality of service. Zoom does not guarantee that alerts will be delivered and will not be liable for delayed or undelivered messages.”
3. Availability & Limitations
“The Text Messaging Service may not be available on all equipment, or through all wireless carriers, and not all functionalities of the Text Messaging Service are available through all wireless carriers. The Text Messaging Service is subject to transmission limitations or interruptions.”
4. User Responsibility for Compliance
“You are responsible for ensuring compliance with the Applicable Laws in the jurisdictions in which You send or deliver text messages.”
5. Policy Binding Agreement
“By utilizing the Text Messaging Service, you agree to be bound by this Policy, which is a legally binding agreement.”
6. Data Privacy & Sharing
Arca Law respects your privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. This includes:
- Phone numbers
- Consent status
- Message history
- Mobile carrier information
Mobile information will not be sold, rented, or shared.
Information may only be shared as required to provide SMS/MMS services, such as with our messaging provider (Zoom) and participating mobile carriers.
7. How We Collect Mobile Numbers
Arca Law collects mobile numbers through our online webforms when clients voluntarily provide their phone numbers for communication purposes.
8. Consent to Receive Messages
By submitting your phone number through our online forms, you consent to receive SMS and MMS messages related to:
- Appointment reminders
- Case updates
- Document requests
- Payment reminders
- Service notifications
Message frequency varies. Message and data rates may apply.
9. Opt‑Out Instructions
You may opt out at any time by replying:
- STOP to end all messages
- HELP for assistance
Opt‑out requests are honored immediately.
